Terms of Service

These Terms of Service govern your use of the Tradeza platform. By creating an account or posting an ad, you agree to be bound by these terms. Please read them carefully.

1. About Tradeza

Tradeza is an online classifieds platform that allows registered users to post, browse, and respond to advertisements for goods and services in South Africa. Tradeza acts solely as a venue for these interactions and is not a party to any transaction between buyers and sellers.

2. Eligibility

  • You must be at least 18 years old to create an account and post ads.
  • You must be a resident of or operating within South Africa.
  • You may not create an account if you have been previously banned from Tradeza.
  • Each person may maintain only one active account.

3. User Accounts

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to:

  • Provide accurate and truthful information when registering.
  • Keep your profile information up to date.
  • Notify us immediately if you suspect unauthorised access to your account.
  • Not share your account with any other person.

4. Posting Ads

When you post an advertisement on Tradeza, you confirm that:

  • You are the owner of, or authorised to sell, the item or service advertised.
  • The ad content is accurate, not misleading, and complies with all applicable South African laws.
  • The item or service is not prohibited (see Section 5).
  • All photos used in the ad are genuine and represent the actual item for sale.
  • You will honour any agreement made with a buyer in good faith.

Tradeza reserves the right to remove any ad that violates these terms without prior notice.

5. Prohibited Items & Conduct

The following are strictly prohibited on Tradeza:

Illegal weapons, firearms without proper licensing, or ammunition
Stolen or counterfeit goods
Illegal drugs or controlled substances
Adult or pornographic content
Live animals sold in a manner violating SPCA regulations
Fraudulent ads or misrepresentation of items
Pyramid schemes or unsolicited bulk advertising
Items that infringe intellectual property rights
Hate speech or content that discriminates based on race, gender, religion, or sexual orientation
Personal data or information belonging to others

6. No Payment Processing

Important: Tradeza does not process payments.

All financial transactions occur directly between buyers and sellers. Tradeza does not hold, transfer, or escrow funds on behalf of any user. Any claim to be a "Tradeza payment system" or similar is fraudulent. Tradeza accepts no liability for any payment disputes, fraud, or financial losses arising from transactions between users.

7. No Delivery Service

Tradeza does not provide, arrange, or guarantee any delivery or courier service. Any delivery arrangements are solely between the buyer and seller. Tradeza accepts no liability for items lost, damaged, or not delivered.

8. Intellectual Property

All content on the Tradeza platform — including logos, branding, and design — is the property of Tradeza and may not be reproduced without written permission. By posting content (text, images) on Tradeza, you grant Tradeza a non-exclusive, royalty-free licence to display that content on the platform for the duration of the ad listing.

9. Disclaimers & "As Is" Basis

The Tradeza platform is provided "as is" and "as available" without warranties of any kind, whether express or implied. To the fullest extent permitted by South African law, we specifically disclaim all warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

Tradeza does not warrant that:

  • The platform will be uninterrupted, secure, or error-free;
  • Any information on the platform is accurate, reliable, or complete;
  • Any seller, buyer, or dealer is who they claim to be;
  • Any item listed is of the quality, condition, or authenticity described;
  • Any transaction between users will be completed successfully.

10. Limitation of Liability

To the fullest extent permitted by South African law, Tradeza, its founder, employees, contractors, agents, and affiliates shall not be liable for any direct, indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses arising from or related to:

  • Your use of or inability to use the platform;
  • Any conduct or content of any other user, including fraudulent, harmful, threatening, or illegal conduct;
  • Any transaction, meeting, communication, or dispute between you and another user;
  • Any item purchased or sold through the platform;
  • Unauthorised access to, use of, or alteration of your data or transmissions;
  • Any bugs, viruses, or errors transmitted through the platform;
  • Any data breach or security incident (notwithstanding our reasonable security measures).

In no event shall Tradeza's total aggregate liability to you exceed the total amount you have paid to Tradeza (for ad posts, boosts, or dealer subscriptions) in the 12 months preceding the event giving rise to the claim, or R1,000 (one thousand rand), whichever is greater.

11. Indemnification

You agree to indemnify, defend, and hold harmless Tradeza, its founder, employees, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in any way connected with: (i) your use of the platform; (ii) your violation of these Terms; (iii) your violation of any third-party rights, including intellectual property or privacy rights; (iv) any content you post or transaction you enter into with another user; or (v) your violation of any applicable law or regulation.

12. Tax & Legal Compliance

You are solely responsible for determining and paying any taxes (including VAT, income tax, or capital gains tax) that may apply to transactions conducted through the platform. You are responsible for complying with all laws applicable to your activities, including but not limited to the Consumer Protection Act, Financial Intelligence Centre Act (FICA) where applicable, and any industry-specific regulations (e.g. vehicle sales, property transactions, firearms licensing).

13. Force Majeure

Tradeza shall not be liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemics, war, terrorism, riots, government actions, labour disputes, power outages, internet or hosting provider failures, or cyber-attacks.

14. Data Breach Notification

In the event of a security breach affecting your personal information, we will notify you and the Information Regulator of South Africa as soon as reasonably possible, in accordance with Section 22 of POPIA. You accept that no online system is completely secure and that notwithstanding our reasonable security measures, breaches may occur. Our liability in such cases is limited as set out in Section 10.

15. Account Termination

Tradeza reserves the right to suspend or permanently terminate any account that violates these Terms of Service, at our sole discretion, with or without prior notice. You may also delete your own account at any time from your profile settings. Upon termination, sections 8–14 shall survive.

16. Dispute Resolution

Before initiating any legal action, you agree to first contact us at legal@trade-za.co.za and attempt to resolve the dispute informally. If we cannot resolve the dispute within 30 days, either party may refer the matter to mediation or the appropriate South African court.

Disputes between buyers and sellers are their sole responsibility. Tradeza is not a party to any transaction and will not mediate disputes, issue refunds for user-to-user transactions, or take sides.

17. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes shall be subject to the exclusive jurisdiction of the South African courts.

18. Severability

If any provision of these Terms is found by a court of competent jurisdiction to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

19. Changes to These Terms

We may update these Terms of Service from time to time. We will notify registered users of significant changes via email or an in-app notification. Continued use of Tradeza after changes are posted constitutes your acceptance of the updated terms.
